Rep. Alexandria Ocasio-Cortez (D-N.Y.) is facing criticism after her office hosted a “Know Your Rights” webinar in February 2025, aimed at informing undocumented immigrants about their legal rights during encounters with Immigration and Customs Enforcement (ICE). The webinar provided guidance on requesting judicial warrants and understanding legal protections.
Former ICE Director Tom Homan, currently serving as the Trump administration’s border czar, accused Ocasio-Cortez of potentially aiding individuals in evading law enforcement, suggesting her actions might violate federal laws. He indicated that he had contacted the Department of Justice (DOJ) to investigate whether her conduct crossed legal boundaries.
Ocasio-Cortez defended her actions, asserting that educating individuals about their constitutional rights is protected under the First Amendment. She emphasized that her intent was to ensure that immigrants are aware of their legal protections and to promote lawful procedures during ICE operations.
The DOJ has not publicly confirmed any investigation into Ocasio-Cortez’s webinar. Legal experts note that hosting informational sessions on legal rights is generally considered lawful and falls within the scope of free speech.
This incident underscores the ongoing debate over immigration enforcement and the extent to which elected officials can engage in advocacy without facing legal repercussions.
